On the 3rd October 2009 a friend of mine, Michael Waters, was killed in a road traffic accident at the junction of the B660 and A14, police reference CF0095460310. Michael Frost the driver of the car involved in the accident was charged and found guilty of causing death by dangerous driving in October this year. Judge Sean Enright sentenced Mr Frost on The 10th November 2010 at Peterborough Crown Court, I understand the court reference No is 35CU/50164/10.

Mr Frost’s sentence was a 51-week prison sentence suspended for two years, 200 hours community service and asked to pay court costs. I consider this to be unduly lenient given the seriousness of the offense and far below the penalties recommended in Section 1 RTA 1988 which are 1 to 14 years in prison, and disqualified for a minimum of two years.

I respectfully request that you refer this case to the Court of Appeal as a potential unduly lenient sentence.

I had a reply from both the CPS and the Attorney Generals Office.
The AGO has asked the CPS for all the information regarding the sentence.

Same here. Arrived this morning.

Owned since 486 miles.Renthal 755 bars, Bagster tank cover, Oxford heated grips, DL650 hand guards, Double Bubble screen, Scorpion Rad guard, Gel pad insert, HLD undertray, Angry Badger tailtidy,  Roadsmart 4s, Givi E21s, E46 topbox, Ohlins shock and YSS cartridge emulators   Currently not fitted - PC3, Remus Revolutions.

Not from these parts.... I (used ) to ride an FJR1300, ( and will again, when I can ride again) before some blonde woman doing a school run ( from my kids school !!!) knocked me off on a sunny afternoon on May 2nd 2009, near RAF Odiham - I died twice at the roadside, took 90 mins for the ambulance to stabilise me, to get me into the ambulance, and a further 90 mins to get me stable enough to move to hospital. I was in Frimley Park (excellent) for 6 weeks and Salisbury Hospital burns unit (also excellent) for a week for grafts... and am still in a wheelchair, recovering very slowly - last operation was a fortnight ago.

My dear wife has advanced MS, I am her carer, we have lost the last two years of her life (and mine) and the "lady" ( Blonde, 4x4, school run) pleaded 100% guilty on the morning of the court hearing in November 2009, 7 months after the offence. I had 12 witnesses, all saying I was riding courteously and within the limit ( 40 in a 50) and she got 5 points and a £200 fine. The Police were as gutted as me. And then Carole Nash said I hadn't advised them of all my accessories, which I definitely had, as sales printed them off for me, but they wouldn't pay out - £3000+ pounds worth !

I just read this thread through, after I came across a link, and thought I too would write to the Attorney General, which I have now done, as I too was grossly
mistreated - blood still boiling in fact...

That's a diabolical story. I hope you're getting better and will get to ride again. Any chances of taking out a civil case against this woman for compensation?

Thanks guys...

I can't say much at this point as my case is ongoing.... we'll see what happens, probably around mid 2011 and what compensation I will be in line for - if its under expectations, I may press for more, but you can probably understand it is all pretty wearing and I can't personally afford to go up paths where I have to pay if I fail... sad.gif I really have had a gutful of it all and just want to be "normal" again, IYSWIM....

Be good to meet up with some of you guys though... I have had my replacement FJR for 16 months and its not moved an inch yet !!

Got another letter from the AGO today....not good news.

"Having carefully reviewed this case, the Solicitor General has concluded that the sentence was not unduly lenient. He has therefore decided not to refer the case to the court of appeal"

Just as a contrast for ya

My mum is now registered disabled after suffering for the last 15 - 20 years with Osteoporosis, Angina and a twisted spine.
10 years ago she started doing a little cash in hand job at her local football club working at the bar, whilst getting disability and JSA.
Now I know as well as she does that this is wrong but no one harmed or put out by it.

Today she had to go to crown court for Fraud and Deception charges, pleaded guilty and was duely dealt with.

She got 300 hours community service, £300 fine and £250 costs and 50 days imprisonment suspended for 2 years.

Shes a 61 year old invalid and would hurt no one there's ya justice system right there.

I feel very sadened for Mikes family and hope they find consolation in the fact that Mikes killer will hopefully die soon

spyball alarm/immob, bluespot brake calipers and Stainless hoses, Fournales air adjustable shock with Remote Resevoir, forks raised 10mm thru yokes, racetech linear fork springs in 15 wt oil, Kappa wingrack/luggage, heated grips, Kedo handguards, dual heat controller to power heated jacket liner and or pants!!, Stebel 136DB horn, K&N air filter, colour matched Baglux tank cover (magnetic tank bag modified to fit cover), osram +50% headloight bulbs, headlight protector,"NitramSpecial" parking loight, tail light indicators all running on LED's & incorporate "Lite Buddies", MK7 Scottoiler fitted, taller screen, 2-2 stainless steel CCC's, Devil stainless down pipes. MKI Renntec engine crash bars & sump guard.
engine changed july 2007 on a dyno run it made 79.1BHP / Torque 59.9Had a brief flirtation with a 1999 MKIIa but it blew an exaust valve on the M5 so was sold on to be repaired.

I don't condone or want to incite violence but if we know/can find out where this guy lives could we not organise a week long rotating(different people every day) GTG in the area on the anniversary(every year) and follow him everywhere he goes so he never forgets.
So long as we swap every time he stops or every half hour or something nobody would get in trouble and with any luck it will scare the bejesus out of him.
