imo death by dangerous driving should be treated the same way as manslaughter

Dear Mr Dalley,
Unduly Lenient Sentence.
On the 3rd October 2009 a friend of mine, Michael Waters, was killed in a road traffic accident at the junction of the B660 and A14, police reference CF0095460310. Michael Frost the driver of the car involved in the accident was charged and found guilty of causing death by dangerous driving in October this year. Judge Sean Enright sentenced Mr Frost on The 10th November 2010 at Peterborough Crown Court, I understand the court reference No is 35CU/50164/10.

Mr Frost’s sentence was a 51-week prison sentence suspended for two years, 200 hours community service and asked to pay court costs. I consider this to be unduly lenient given the seriousness of the offence and far below the penalties recommended in Section 1 RTA 1988 which are 1 to 14 years in prison, and disqualified for a minimum of two years. I ask that you refer this case to the Attorney General.

The more complaints the CPS receive could possibly make a difference.

The only thing I would ask is that letters are civil... no effing and jeffing.

I can understand, though I don't agree with it, the judge being swayed not send him to prison, but why was he not banned from driving? What's the judge going to say should this man cause another serious injury or death because he's still free to shunt that tank around.

I think the prosecutors/police can appeal against a too lenient sentence.

Thanks for letting us know Roy, if there's anything we can do to help in getting this scum the sentence he deserves, I'm sure it's no trouble for any of us here.

I also think the ins. companies, all of 'em, should refuse point blank to insure anyone found guilty of death by dangerous driving and they should be banned from driving for ever.

Did get a ban, but only 2yrs.

Should have been permanent...

This is just what I've come to expect, a friend of a friend was killed in very similar circumstances. He was in his early twenties and the woman driving and proved to be at fault didn't get locked up either. (this was in a 30 zone)

When a biker does 160mph he gets six months inside as he may have had a bad accident at that speed, not that he did but he could have done.

When a car driver kills a motorcyclist by dangerous driving, he gets away with a fine. WTF

Makes my fucking sick but it happens all the time, MAG BMF etc. should get of their arses and do something. I've quit membership of both these organisations as they do fuck all for our cause!

Didn't see that, too busy picturing in my mind what took place that day, but yeah, 2 years is not enough.

Looking at the link, it appears that motoring offences are not included in those that may be appealed on the ground of undue leniency. Be interested to hear their response.

Looking at the bottom of the page on the CPS web site we have ....

Examples
At the Old Bailey, a defendant was convicted of causing death by dangerous driving and ordered to do community service. The CPS referred the case to the Attorney General, who referred it to the Court of Appeal. The sentence was increased to a prison sentence of three and a half years.

That is the sad part Tony, whatever happens it wont bring Mike back but I feal I owe it to him to try to make the t**t who killed him suffer as much as legally possible. Maybe then he will realise that it isnt 'just another biker' he has killed by driving dangerously but a son, father, grandfather, future husband and a really nice guy. Mike told me a few weeks before he was killed that his daughter was pregnant with his second grandchild, a lovely little girl he never saw.

Difficult and emotional topic - we can only hope the 200 hours is something worthwhile for the community in general and hard work at that - only tiniest consolation is that we, as the taxpayers, aren't paying the £45k per year to keep the twat in prison!

Disgraceful, should have been banned for at least 5 years and made to take a re-test.

Although they don't necessarily get long bans, new drivers have to re-take their test if they get 6 points on their licence in the first two years of driving, even if they were minor infringements - so whats wrong with banning and making older drivers do the same if they cause a serious accident? I wonder what his sentence would have been had he reversed up onto a pavement and killed a child or elderly person?

Like it or not, many non-motorcyclists reading that article will just shrug their shoulders and say motor bikes are dangerous and we know what the potential consequences are, even though 8 out of 10 accidents involving bikes and other vehicles are proven to be the other vehicles fault! They will still continue to drive their cages listening to the radio, playing with their phones or be distracted by kids on a school run (my real big hate) without giving a shit about other road users or the potential consequences of their lack of concentration ranting.gif

RIP Stormy; I only ever met him once but he seemed a really nice guy and knew a hell of alot about bikes
Now on 9er number 2 .....
