This seems to be doing the rounds at the moment. but yeah, the case law was passed 6 years ago.

 

Good to know if you have an accident with them circs.

 

Filtering in traffic moving abover 10mph though and its not so easy

I was told by the old bill when I did the Bikesafe course that their yardstick was 15mph. That is to say, if you are filtering in stationary traffic then any more than 15mph could be construed as driving without due care and attention. Similarly, if the traffic is doing 10mph, then it's fine to do 25mph. I've used this as measure since then.

sorry the 10mph was just wa guestimate number.

 

Speed of travel doesnt really matter when it comes to case law. its more a case of was the speed reasonalbe of excessive. If a case goes to court, this is deemed by the judge.

 

There are case laws where people have admitted to traveling over the speed limit and although this has contributed towards there negligence they still not held completly at fault.

 

Supprisingly a lot of case law involving speed also involves motorcycles ! much to my disapointment when I had to train new starters at work with it ! Puts us bikers in a bad light

The rights and wrongs don't come into it when there a life in a wheelchair to consider. I was taught to filter by a retired bike cop BUT at low speed relative to the other traffic (previous posts 10 mph relative speed seems very reasonable), and to realise it was a risky manoeuvre so my awareness needs to be at it's utmost. I do filter, and I do sometimes have to brake for idiots!
