I will never forget the final moments of having to prepare to hit the side of a toyota avensis and plan my launch.

A taxi pulled out on me from a T junction and just stopped - I tried to take avoiding action, but hit his wing just in front of the front wheel.
I summersalted over his bonnet and my heels took the impact and I think I rolled onto my back the came to rest on my left side. Visor went flying.
It happened right outside a pub.
Pisspots pawing me and wouldn't let me get up.
My kness hurt.
Having a drink now and Ambulance advised a visit to A and E ... in the morning.
The NW fettling Day may include the refit of new forks.... lolzzz
I looked at the bike for merely seconds, but I think the forks are goosed. Top fairing is ok. LHS fairing gone, indicator also.

Sounds like you had a lucky escape there even if the bike didn't fare so well.
Hope you got his number!
Make sure you get to the A&E, take care of yourself!!

Very sorry to hear this and thankful you aren't too badly done over even though the bike is a bit. Did you manage to get a witness? Got to be 100 per cent his fault bang up. Hope you get a good settlement with his insurance company.

the police attended and as far as they are concerned he pulled out on me and should have given way. Regardless of the speed I was doing.
They have done him for undue care and attention but will probably get offered a driver improvement course instead of the charge, so says the police.
All the witnesses had gone by the time I exited the ambulance.
Will the insurance try to fight his arguments or is it open and shut because of the police intervention?

IMHO if the police are doing him he's toast.
He pulled out, you would have had right of way by the sound of it, speed isn't an issue, his lack of attention/ careless/dangerous driving is.
Make sure you claim for your damaged clothes and helmet, alot of people forget that apparently.

At least your okay but a visit to the hospital is a must although many of us cant be bothered, guess your pissed off about the bike but it will mend eh.

I reckon any crash you walk away from is a good one. Glad you're OK! Bikes are replaceable.

Sounds just like that TV ad! Dipstick driver. Take nothing for granted re the claim, try get witness statements off the police if they took any, however from what you say you should be OK, Hospital visit a must

Glad you're not to badly injured, it's easier to fix a bike than a body!

I would get in touch with some specialist bike accident solicitors to deal with it for you. A similar thing happened to me about 8 years ago and the police ended up saying it was 'just one of those things'. When my insurance company heard that they lost interest...

So get down to A&E so that you have a record of your injuries, list all of the damage to your kit (any protective equipment will need replacing) and get your bike to a main dealer for an estimate. Then contact White Dalton (http://www.whitedalton.co.uk/) or someone like that who specialises in biking injury and damage claims!

Good luck, bet you will be feeling really sore this morning!

Glad to hear you are ok, Mind & get yourself checked out at A&E.
Watch that Taxi's driver doesn't all of a sudden have 10 Taxi mates that were there & say its you fault.

Thanks for the kind words everyone.
Regarding the insurance side of things, my partner works in the litigation and P.I. claims industry as a fee earner.
( well she says "unqualified solicitor" lol) so hopefully all should be easier work than normal.
The police were fantastic and on the scene in minutes.
They mentioned how he should have given way due to the road markings and big triangle that says give way.
The taxi driver said I was going too fast.
The police said that proves he saw me so they did him for undue care and attention lol
They say if I was going too fast why did he pull out on me?

It would be attempted murder in another section of law lol.

Oh I do hope the Gleam machine isn't too poorly, she has been purring like a lion recently and we were so in love. I'll visit her today with some super resin polish and autosol, just to let her know she's my world.

Really glad you escaped this one relatively unscathed Erny - main thing is that you seem OK (apart from that severe whiplash that's coming on wink.gif )
I'm sure you'll find the Gleam Machine will be repairable.

I feckin' hate these taxi drivers - they like to think they're 'professional drivers' but in reality they're a bunch of chancers poling around in derelict wrecks mad.gif

At least you've got through your SMIDSY prang without serious injury, that's the main thing - now take the b*stard to the cleaners so he won't do it again

good to hear that your OK - as many have said, your bike can be repaired but broken people are much trickier

I have a bit of experience of this and my take is that you need to try to procure a witness if at all possible. The taxi guy's insurance will (without any doubt) try to shift the burden of blame to you and will take very little heed of the police - i had a similar thing happen when i was hit from behind in my car whilst stationary!!. Might not be a bad idea to pop to the pub in question and ask if anybody would be willing to come forward as a witness - you would be amazed at how forthcoming people can be once the Old Bill are not around! Failing that, I'm sure you must know somebody local that was around, saw the accident, but didnt stop because they were rushing to pick their kids up but now feels awful and has come forward tongue.gif tongue.gif tongue.gif

A decent specialist solicitor will help immensely, the classified pages of MCN are full of them - that said, recommendation is always best - anyone? That witness is going to help things immensely in terms of payout and speed of resolution.

Again, glad to hear that you are relatively unscathed - could have been any one of us and could have been much worse.

just got back from A and E, and they say my kness are badly bruised, so is my hand and apart from that I'm ok.
A few people came forward as witnesses last night, but when I exited the ambulance no one was around.
I'll go to the pub tomorrow and enquire.
Many thanks again for the kind words.
Iexpect the insurance to try and wriggle out of it. But missus says , no matter what the driver says, the police charged him with undue care and attention.
We shall see and will keep you updated.

Sorry to hear about the bike, glad to hear you're alright though. Nail the fucker for everything. I absolutely hate taxi drivers, which is very difficult considering how many friends of mine drive them.

I'll second that. Glad you're OK. Get a decent solicitor (you don't have to use the one your insurers refer you too) and screw them for everything, bike, clothing, injury.

Dont worry about the bike even if it is sickening.. as long as your OK ;sort of; As for Taxi drivers danceswithmopeds is right on .. hope it wasn,t one of his mates that cleaned me at the Swords roundabout afew years back.. putemup.gif Take it easy for a while
