
Bennetts V Criminal Conviction

2005. Parked up at Warwick services, old guy with Caravan reverse's into my Mustang, drives off, i catch him, he comes back, admits fault and i get 3 witness's who confirm i was not moving.
I get quotes to repair front bumper. forward them on to him. FOUR WEEKS later I write to him again saying I want to sell the car and please respond. 2 days later his Son calls to say he's in Portugal for 6 months, he's retired
I spend Sunday afternoon repairing the car myself, sell it and move on.
3 months later the old guy rings me
I want to pay you for the damage.
Too late chap, I sold her, repaired it myself,
oh, ok, how much do you think is fair?
£100 plus paint (quotes were £300/400)
Thats fair he says, sends me a cheque.
I forget all about it.
4 months later I am arrested and charged with one count of fraud and deception. The old guy thinks that I did not repair the car and conned him.
I plead not guilty and it goes to court.
Even though: I had witness statements, halfords receipt showing paint n paper, I could not prove the car had been repaired. I asked for the car to be at court but it is in Scotland, on one of the remote places, the new owners have put a 'Tribal sticker' on the bumper and refuse to remove it for photos to be taken.
That was in 2006.
Been a pain in my arse since, runs out in November 2011. I have always declared it and its been ok.
Bennetts have insured me since 2007 and never been an issue, till today. Rang them to say bike change, and they ask me shit loads of questions, job change? yes i say. Work for the NHS logistics. Oh, they say thats a problem.
Why? NHS is one of the UK's biggest employers I say.
Nope, we cant insure you. Err yes you can, anyway, goes on for a while and he finally mentions the conviction.
We are ending your policy and will refund you the balance.......goodbye........goodbye? i am truly in tears. What went wrong?
Rang around and Carole Nash, Ebike and Devitts all not wanting to know,
I am now talking to a specialist who will charge me not the £170 i was paying but £600.
Cars are insured with Directline and they said: whats a criminal conviction got to do with your driving ability?
Could do with any input or leads advice here.
Right now I wish I had gone to Manchester found the Old git and his caravan and burnt him inside it, the punishment would have been less

sheesh, there's summat wrong there mate. I know it's too late now but you should have phoned the cops and got him done for leaving the scene and gone through the ins co. to claim off him.
I recently got me an old car after managing without one for over a year. As a result I've lost ALL my years of no claims 7 or 8 years simply because I was without a car for a year ! Fookin stinks dunnit ! cost me £200 to insure a £250 car !
Did you find out what the exact details Carole Nash etc have on you regarding the conviction ? It's not as if you were trying to defraud the ins company so I don't see why they're doin what they're doin ?

The incident was over 5 years ago.
Im sitting on this till I calm down then going for Bennetts Customer Service Dept. How can they insure me for over 4 years and then decide not to, when I have been a good boy, paid premiums and told them of any changes.
Fuck it, they cannot do this. See what happens

Puzzles me how the case got upheld - if you'd sold it without repairing the damage you'd've had to allow a bit off for the dented bumper - so his payment would have been 'recompensing' you for your loss.
Fact you actually repaired it means you were out of pocket, so payment was recompense for your expenses. Either way, he was liable for either damage or damages.
Guy hit me on the 850, dented the standard can, settled privately for the cost of an aftermarket can cos a new Starship Enterprise would've been twice the price.

Have you tried going through a broker rather than direct to an insurance company? They'll check a load of companies so may find more that'll touch you.

In all honesty, I think your lucky to get away with not having to pay 6-700 quid ins for the past 4 years, maybe through an error on the ins. co.

That really sucks.
I don't understand why it is a problem for car insurance and not for your bike...or have I missed something?
Best approach appears to be to wait for the end of the 5years. Going to a specialist insurer now may ring the alarm bell to all others next time you want to renew insurance and they check your recent records!

Given some recent telephone conversations with my solicitors, I now genuinely have trouble seeing the point in insurance.
